1. Purpose

his Acceptable Use Policy (“AUP”) forms part of the Funnelish Terms of Service. It sets out what may not be sold through, or done with, the Services. It exists to protect shoppers, other merchants, our payment and messaging partners, and the platform itself. We update it as laws, partner rules and our risk experience change; the effective date above is the current version.

Many of the restrictions below reflect the rules of the payment providers, card networks, carriers and advertising platforms that Funnelish integrates with. Where a provider’s rules are stricter than this AUP, the provider’s rules apply to the parts of the Services that depend on it.

2. Prohibited products and businesses

You may not use the Services to sell, promote or facilitate any of the following:

CATEGORY

INCLUDES

Illegal goods and services

Anything illegal where you, we, or your shoppers are located; stolen goods; goods that infringe sanctions or export controls.

Counterfeit and infringing goods

Replicas, knock-offs, unauthorised reproductions, items that use trade marks, copyright works, designs or likenesses without permission, including “inspired by” products that imitate branded goods.

Weapons and dangerous items

Firearms, ammunition, firearm parts and accessories, 3D-printed gun files, explosives, fireworks, knives marketed as weapons, stun guns, pepper spray where restricted, military or police equipment.

Drugs and drug paraphernalia

Controlled substances, cannabis and CBD products where not lawful for sale and shipment in every jurisdiction involved, kratom, nootropics marketed for drug-like effects, research chemicals, equipment for producing or consuming drugs.

Tabacco, nicotine and vaping

Cigarettes, cigars, e-cigarettes, vape devices and liquids, nicotine pouches and related products, unless approved by us in writing and sold only where lawful with age verification.

Adult content and services

Pornography, sexually explicit material, escort and dating services with a sexual element, adult toys where our payment partners prohibit them.

Gambling and prizes

Gambling, betting, lotteries, raffles, sweepstakes and skill games with cash prizes where not licensed and lawful, fantasy sports with entry fees.

Financial products and crypto

Lending, credit repair, debt collection, investment advice, securities, forex, binary options, cryptocurrency sales, mining contracts, tokens, NFTs, wallets, “passive income” and trading-signal products.

Pyramid, HTML and get-rich-quick

Multi-level marketing recruitment, pyramid or matrix schemes, business-opportunity or “work from home” offers that promise income, coaching sold on earnings claims, unregistered franchises.

Unsubstantiated health claims

Supplements, cosmetics, devices or programmes marketed with claims to cure, treat or prevent disease, cause weight loss or enhance sexual performance without substantiation; products containing ingredients banned or restricted by the FDA, MHRA, EMA, HSA or equivalent; prescription medicines; peptides and hormones.

Deceptive practices

Hidden or inadequately disclosed recurring charges; “free trial” or “just pay shipping” offers that convert to subscriptions without clear, conspicuous consent; fake scarcity, countdowns or reviews; impersonation of brands, celebrities or government bodies; drop-shipped goods misrepresented as to origin, delivery time or quality; non-delivery.

Hate, violence and harm

Content or products that promote hatred, discrimination, violence, terrorism, self-harm or cruelty to animals; human trafficking; endangered-species products.

Regulated and high-risk without approval

Alcohol, travel and timeshares, telemarketing services, ticket resale, pawn, bail bonds, charity and donation collection, government documents, pharmacy, and any business requiring a licence you do not hold. These may be permitted with written approval from us and compliance with provider rules.

We may add categories to this list, and may decline, restrict or close any store that in our reasonable judgement presents a legal, fraud, chargeback or reputational risk, even if it is not listed. Where we restrict rather than prohibit a category, we may require evidence of licences, age verification, geo-blocking or other controls.

3. Prohibited conduct

You may not, and may not allow anyone using your account to:

  • breach any law, regulation or third-party right, or use the Services for an unlawful purpose;

  • collect, store or process shopper data without a lawful basis and the required notices and consents, or collect card data outside the PCI-compliant payment fields we provide;

  • misrepresent who you are or what you sell; use misleading pricing, fake reviews, fake badges, fake urgency or dark patterns; or fail to honour your own policies;

  • send spam or any unlawful or unconsented marketing by email, SMS or other channels (see section 4);

  • upload or distribute malware, phishing content or malicious scripts; attempt to gain unauthorised access to any system; probe, scan or test the vulnerability of the Services without written permission; or circumvent authentication, rate limits, usage limits or security controls;

  • scrape, crawl or harvest data from the Services or from other merchants’ stores other than through documented APIs and within their terms;

  • reverse-engineer, decompile or copy the Services, templates or components outside the platform; build a competing product using them; or use Funnelish AI output to train competing models;

  • use Funnelish AI to generate content that is illegal, infringing, deceptive, hateful, sexually explicit or that impersonates real people, or to produce regulated advice presented as professional;

  • share accounts across unrelated businesses, resell access, or operate multiple accounts to evade a suspension or limit;

  • interfere with other customers’ use of the Services, or place unreasonable load on infrastructure (for example by abusing free tiers, credits or automated traffic);

  • use the Services from, or for the benefit of, a person or country subject to comprehensive sanctions.

4. Messaging rules

When sending email or SMS through the Services you must:

  • hold prior consent that meets the law of the recipient’s country — for marketing SMS to U.S. numbers, prior express written consent under the TCPA; for marketing email and SMS to UK and EU individuals, consent under PECR and the ePrivacy rules or a valid existing-customer exemption; for Singapore, Canada and Australia, consent as required by the Spam Control Act, CASL and the Spam Act;

  • identify yourself clearly as the sender in every message and include a working opt-out that is honoured within the time the law requires (and in any case within 10 days for email and immediately on STOP for SMS);

  • keep records of consent, including the source, date, time and wording;

  • respect quiet hours and frequency limits where the law or carriers impose them;

  • not send messages about prohibited categories, and comply with carrier content rules (for example CTIA guidelines and 10DLC registration requirements in the U.S.);

  • not use purchased, rented, scraped or third-party lists.

We monitor complaint rates, bounces, spam-trap hits and carrier feedback. We may throttle or suspend sending, require list cleaning or registration, or terminate messaging features for accounts whose traffic threatens deliverability for other customers or breaches carrier rules.

5. Content standards

Content on stores built with the Services must be lawful, accurate, your own or properly licensed, and appropriate for a general audience unless the store is lawfully age-gated. Product descriptions, pricing, shipping times, origin and return terms must be truthful. Claims must be substantiated. Testimonials and reviews must be genuine, from real customers, and compliant with the FTC Endorsement Guides, the UK CMA guidance and equivalent rules. You must respond to copyright, trade mark and other rights complaints promptly and remove infringing material.

6. Enforcement

If we believe an account breaches this AUP we may, depending on severity: ask for information or corrective action; remove or disable content; restrict features such as messaging, AI or payment integrations; place the account under review; suspend the account; or terminate the Agreement. We give notice and a chance to cure where it is practicable and safe to do so, but may act without notice where there is a risk to shoppers, other customers, our partners or the platform, or where the law requires it. Suspension does not pause fees. Repeated or serious breaches result in termination without refund, and we may report unlawful activity to authorities and payment partners. You may appeal an enforcement decision by writing to legal@funnelish.com; we will review and respond.

7. Reporting abuse

To report a store or content that you believe breaches this AUP, email abuse@funnelish.com with the URL, a description and your contact details. Copyright complaints follow the procedure in the Terms of Service. We investigate reports and act where warranted, but do not always respond individually.
